1. Acceptance of Terms
By accessing or using the ESN Microcredit platform and related services (the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Services.
2. Eligibility
You must be at least 18 years of age and legally capable of entering into binding agreements in your jurisdiction. By registering, you represent that all information you provide is accurate and complete.
3. Account Registration
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to notify us immediately of any unauthorised use of your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4. Loan Services
ESN facilitates micro-credit services between retailers and our lending partners. Loan terms, interest rates, repayment schedules, and eligibility criteria are presented at the time of application and are subject to approval. ESN reserves the right to modify lending terms at any time with prior notice.
5. Repayment Obligations
Borrowers agree to repay all loan amounts including accrued interest by the agreed due dates. Late payments may incur additional fees and may be reported to credit bureaus. Failure to repay may result in collection actions in accordance with applicable law.
6. Prohibited Conduct
- Providing false or misleading information during registration or loan application.
- Attempting to access another user’s account without authorisation.
- Using the Services for money laundering, fraud, or any unlawful activity.
- Reverse-engineering, decompiling, or interfering with the platform’s infrastructure.
7. Intellectual Property
All content, trademarks, logos, and software on the platform are the property of ESN Microcredit or its licensors. You may not reproduce, distribute, or create derivative works without our prior written consent.
8. Limitation of Liability
To the fullest extent permitted by law, ESN shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of the Services. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.
9. Disclaimer of Warranties
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee uninterrupted access or error-free operation.
10. Modifications
We may revise these Terms at any time. Material changes will be communicated via email or an in-app notice at least 14 days before taking effect. Your continued use of the Services after the effective date constitutes acceptance.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Republic of Tanzania. Any disputes arising from these Terms shall be resolved through arbitration in Dar es Salaam.
